1. What this covers
This waiver covers your participation in any LeagueTen season, match, playoff or event, including travel to and from courts and time spent at courts ("League Activities"). LeagueTen LLC, its owners, members, managers, employees, volunteers and ambassadors, and, to the extent the law allows, the owners and operators of the courts where you play, are called the "LeagueTen Parties."
2. The risks
Pickleball is a physical sport. Playing involves risks that can't be removed, including:
- sprains, strains, falls, fractures, and injuries to joints, muscles, eyes and head;
- being hit by a ball or paddle;
- heart problems, dehydration and heat illness, especially in South Florida weather;
- court conditions, such as wet, uneven or damaged surfaces, poor lighting, nets and fences;
- the actions of opponents, partners and other people at the court;
- injury, theft or loss while traveling to, from or at a court.
3. Courts are not ours
LeagueTen doesn't own, operate, inspect or supervise any court. Players choose where to play. LeagueTen doesn't provide supervision, referees, first aid or equipment.
4. Your responsibilities
You confirm that you are 18 or older, physically able to play, and that you'll:
- check with a doctor if you have any health concern before playing;
- warm up, stay hydrated and use proper shoes and, if you choose, eye protection;
- look at the court before playing and not play on a court that seems unsafe;
- stop playing if you feel unwell or are injured;
- follow each court's rules and posted hours.
5. Assumption of risk
You understand these risks and freely choose to take part in League Activities. You accept all risks of injury, illness, death, or loss or damage to property, whether known or unknown.
6. Release
To the fullest extent the law allows, you release and agree not to sue the LeagueTen Parties for any injury, illness, death, or loss or damage to property arising from League Activities, INCLUDING CLAIMS BASED ON THE NEGLIGENCE OF THE LEAGUETEN PARTIES, except for gross negligence or willful misconduct.
7. Indemnity
You agree to cover the LeagueTen Parties' reasonable costs, including legal fees, for claims brought by anyone else because of your actions during League Activities.
8. Medical care
If you're injured, you're responsible for getting and paying for any medical care. You confirm you have health insurance or accept these costs yourself. You allow the LeagueTen Parties, if they're present, to call for emergency help on your behalf.
9. General
This waiver is governed by Florida law. If any part is found unenforceable, the rest still applies. It applies to every season you join until you agree to an updated version.
